Employer Nomination Scheme

The Employer Nomination Scheme (ENS) subclass 186 visa is a permanent migration visa.  As the name suggests it requires nomination for an Australian Employer.  The process is similar to the subclass 457 program being that an Australian Employer must lodge application for approval of nomination for the skilled position and the skilled worker lodges visa application to fill the nominated position.  Within the program there are three distinct streams;

  • Temporary Residence Transition
  • The Direct Entry
  • The Agreement Stream

Temporary transition stream is for skilled workers that for at least 2 years in the period 3 years prior to application;

  • held a primary subclass 457 Temporary Skilled Work visa;
  • worked in the same position for the same nominating employer which is being nominated under ENS;

Note this is a general overview of the requirements.  There are additional circumstances where this Temporary Residence Transition may be satisfied if the employer has changed but the position has remained the same over the 2 year period.  The advantage of this stream includes concessions on the requirement to provide positive skills assessment in the nominated occupation and lower level of formal English test results.

The Direct Entry Stream is for skilled workers in or outside Australia nominated by an Australian Employer for a skilled position.

The Agreement Stream is for applicants which may not satisfy the requirements of Temporary or Direct Streams and demonstrate special exemptions that have been approved by the Minister for Immigration.

Each business and individual circumstances must be taken into account when selecting and pursing an ENS application.  Failure to identify and pursue the correct stream can be costly and significantly complicate what could otherwise be a positive application decision.
